ORDER

This case for the redetermination of a deficiency was called from the calendar for trial in Dallas, Texas, on October 30, 2023, during the trial session that started in that city on that date. The parties appeared and announced that a basis of settlement had been reached.

Premises considered, and for cause set forth more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion to dismiss for lack of prosecution is denied, without prejudice. It is further

ORDERED that not later than December 29, 2023, the parties, jointly or separately, report in writing as to the status of the case, unless a proposed stipulated decision is submitted sooner.
