ALEJANDRO FIERRO, Appellant, v. THE STATE OF TEXAS, State.
Appeal from the
120th District Court
of El Paso County, Texas
(TC# 20120D00748)
ORDER
On June 10, 2014, this Court granted the State's motion to supplement the record and ordered that the supplemental reporter's record be filed on or before July 25, 2014. The Court is in receipt of the court reporter's letter dated June 20, 2014, wherein she represents that neither party believes it is responsible for the cost of preparing the requested addition to the reporter's record. No financial arrangement has been made for the preparation of the requested addition to the reporter's record.
It is therefore ORDERED that the trial court conduct a hearing to determine whether the State's requested addition to the reporter's record is necessary to the appeal. If the trial court determines that all or part of the requested additions are unnecessary to the appeal, the trial court shall determine whether the State must pay the costs for the preparation of the unnecessary additions. See Tex. R. App. P. 35.6(c)(2). If the trial court determines that the requested additions to the reporter's record are necessary to the appeal, the costs of the additional requested material shall be borne by Appellant in accordance with Rule 35.6(c)(2). It is ORDERED that the trial court's findings and the reporter's record of the proceedings shall be forwarded to this Court on or before July 11, 2014.
IT IS SO ORDERED this ay of June, 2014.
