STIPULATED MOTION FOR ORDER ENLARGING TIME FOR DEFENDANT'S FIRST APPEARANCE


With the stipulation of plaintiffs counsel, defendant moves the Court for an order granting an extension of time to and including January 31, 2003, in which defendant may file an appearance in this matter. By filing this motion, defendant preserves, and plaintiff stipulates that defendant does not waive, any substantive or procedural rights, including defenses of personal jurisdiction, improper venue, statute of limitations, and the right to file Fed.R.Civ.P.12(b) motions or any other defenses or objections

IT IS SO STIPULATED:

ORDER

Based upon the parties' foregoing Stipulation, and the Court deeming itself fully advised in the premises, it is hereby ORDERED that defendant shall be granted an extension of time to January 31, 2003, in which to file an appearance in this matter.
