In an action to recover damages for personal injuries, for medical expenses and loss of services, the appeal is from an order dismissing the complaint pursuant to subdivision 5 of rule 107 of the Rules of Civil Practice, and from the judgment entered thereon. Order and judgment unanimously affirmed, with $10 costs and disbursements. No opinion.
