From the 216th Judicial District Court, Kerr County, Texas
Trial Court No. A16292, A16293, A16294 & A16295
Honorable N. Keith Williams, Judge Presiding
ORDER
Appellant Logan Field filed separate notices of appeal for four related trial court causes in appeals numbered 04-17-00321-CR, 04-17-00322-CR, 04-17-00323-CR, and 04-17-00324-CR. The clerk's and reporter's records are due on June 5, 2017.
On May 22, 2017, Appellant moved this court to consolidate these appeals. Appellant asserts each appeal pertains to the same event and the same grounds for a motion to suppress. The State has not objected to Appellant's motion.
Appellant's motion to consolidate these four appeals is GRANTED IN PART. The parties must file motions, briefs, and other pleadings as if the appeals were one, and the parties must include all four appeal numbers in the style of the case. Any further orders will include each of the four appeal numbers.
However, a separate appellate record must be maintained for each appeal. The trial court clerk shall prepare and file a separate clerk's record for each trial court cause. If the clerk's record is supplemented, the supplemental material must be filed in each appeal to which it applies.
Because the merits of all four indictments were argued together in the motion to suppress, plea, and sentencing hearings, the court reporter may file a single reporter's record for each requested hearing. Each volume the court reporter files must include all four appeal numbers in the heading and shall be filed in appeal number 04-17-00321-CR. When the court reporter files the reporter's record, this court will place a copy of the reporter's record in the appellate record for each of the other three appeals.
Appellant's brief must present for review any issues Appellant wishes to raise from any of the appeals; the State's brief may respond to Appellant's issues. See TEX. R. APP. P. 38.1, 38.2. Appellant may file a reply brief. See TEX. R. APP. P. 38.3. Each brief's caption must include the numbers for all four appeals. Any other documents the parties file must likewise contain all four numbers.
If this court orders submission by oral argument, the consolidated appeal must be argued within the applicable time limits for a single appeal. See 4TH TEX. APP. (SAN ANTONIO) LOC. R. 9.1. This court will dispose of all four appeals with one opinion, judgment, and mandate.
