PRESENT: , P.J., CENTRA, CARNI, SCONIERS, AND MARTOCHE, JJ.

An appeal having been taken herein from an order of the Family Court, Allegany County, entered in the Office of the Clerk of said Court on June 9, 2010, and appellant having moved to strike portions of respondent's brief, and for an extension of time to file and serve a reply brief,

Now, upon reading and filing the affidavit of John A. Cirando, Esq., sworn to March 23, 2012, the notice of motion with proof of service thereof, the affirmation of Mark C. Davison, Esq., dated April 4, 2012, and the affidavit of Elizabeth deV. Moeller, Esq., sworn to April 6, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to strike portions of respondent's brief is denied with leave to renew in appellant's reply brief, and

It is further ORDERED that the motion insofar as it seeks an extension of time to file a reply brief is granted on condition that appellant submit ten copies of his reply brief to the Court, together with proof of service, on or before June 1, 2012, and the Clerk is directed to accept said briefs for filing.
