Action to recover damages for personal injuries and for property damage alleged to have been sustained by plaintiff through the negligent operation of defendant's automobile. On argument, order denying plaintiff's motion for a preference reversed on the law and the facts, with ten dollars costs and disbursements, the motion granted, and the case ordered to be placed on the calendar for November 2, 1942, subject to the consent of the Justice presiding. We are of opinion that under the circumstances here presented the plaintiff is entitled to an early trial. Lazansky, P.J., Hagarty, Carswell, Adel and Taylor, JJ., concur.
