LANCE FERRAND, PLAINTIFF-APPELLANT, v. TOWN OF NORTH HARMONY AND BRUCE STEVENSON, DEFENDANTS-RESPONDENTS.


PRESENT:

Appellant having moved for an extension of time to perfect the appeal taken herein from an order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Chautauqua on September 24, 2015, and respondents having cross-moved to dismiss the appeal for failure to timely perfect,

Now, upon reading and filing the affirmations of Brian Chapin York, Esq., dated April 8, 2016, May 4, 2016, the affirmation of Thomas M. Lewandowski, Esq., dated April 14, 2016, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that appellant's motion is granted to the extent that the ordering paragraph of the order of this Court entered February 11, 2016, is hereby amended by deleting the date April 11, 2016, and inserting in its place the date June 15, 2016, and

It is further ORDERED that respondents' motion is denied.
