Upon the papers filed in support of the motions and the papers filed in opposition to the motion to dismiss and the motion for permission to proceed as a poor person, it is

ORDERED that the motion to dismiss the proceeding is granted, without costs, and it is further

ORDERED that the motions for permission to proceed as a poor person and for injunctive relief and for further relief are denied, without costs, as academic.
