DECISIONS PURSUANT TO RULE 1:28.

So much of the judgment as dismissed the plaintiffs 42 U.S.C. § 1983 claim is vacated and the case is remanded to the Superior Court for further proceedings consistent with the memorandum and order of the Appeals Court. In all other respects, the judgment is affirmed.
