Order reversed upon the law and the facts, with ten dollars costs and disbursements, and motion to dismiss complaint granted, with ten dollars costs, upon authority of Fellmeth v. City of Yonkers ( ante, p. 815), decided herewith. Lazansky, P.J., Rich, Young, Hagarty and Carswell, JJ., concur.
