DECISION & ORDER ON MOTION

Motion by Perrault Hervey Felix, Jr., sued herein as "John Doe," for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Queens County, entered November 2, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the appeal is dismissed on the ground that appellant Paulette Talford is not aggrieved by the order appealed from, which decided a motion made by Perrault Hervey Felix, Jr. (see CPLR 5511); and it is further,

ORDERED that the motion by Perrault Hervey Felix, Jr., sued herein as "John Doe," is denied as moot.
