Defendant-respondent having moved for leave to appeal to the Court of Appeals from the decision and order of this Court, entered on March 23, 2021 (Appeal Nos. 13375-13375A), (M-2021-01519),
And the Metropolitan Transportation Authority, and its affiliated and subsidiary agencies, the New York City Transit Authority, Manhattan and Bronx Surface Transit Operating Authority, Staten Island Rapid Transit Operating Authority, MTA Bus Company, the Long Island Railroad Company, Metro-North Commuter Railroad Company, and the Triborough Bridge and Tunnel Authority, having moved to file a brief amici curiae in support of defendant-respondent's aforesaid motion for leave to appeal to the Court of Appeals (M-2021-01502),
And the New York State Thruway Authority and the New York State Department of Transportation having moved to file a brief amici curiae in support of defendant-respondent's aforesaid motion for leave to appeal to the Court of Appeals (M-2021-01632),
And the City of New York having moved for leave to file a brief amicus curiae on behalf of the Port Authority of New York and New Jersey in support of the Port Authority's motion for leave to appeal to the Court of Appeals (M-2021-01659),
Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is ordered that the aforesaid motions (M-2021-01502; 2021-01632; and 2021-01659) seeking leave to file briefs amici curiae in support of defendant-respondent's motion for leave to appeal to the Court of Appeals are granted and the six copies of the proposed briefs amici curiae and the proposed brief amicus curiae submitted to this Court with the moving papers are deemed filed, and
It is further ordered, upon due consideration of all submissions, that the defendant-respondent's motion for leave to appeal to the Court of Appeals from the decision and order of this Court, entered on March 23, 2021 (Appeal Nos. 13375-13375A), is denied (M-2021-01519). Entered: June 22, 2021
