Feinstein v. College Point Country Club, Inc.

Appellate Division of the Supreme Court of New York, Second Department
Nov 20, 1961
14 A.D.2d 906 (N.Y. App. Div. 1961)

Opinion

November 20, 1961

Motion by plaintiffs to dismiss the appeal taken by the defendant Fontecchio and the appeal taken by the seven proposed party defendants named in the caption, from an order dated August 1, 1961, which granted plaintiffs' motion to vacate the prior proceedings in this foreclosure action, to add new parties as defendants, and to serve a supplemental summons and amended complaint upon all defendants. Motion granted; appeals dismissed. It appears that these appellants are not aggrieved by the order and that it does not affect any of their substantial rights (Civ. Prac. Act, § 557, subd. 1; § 609, subd. 4). Nolan, P.J., Ughetta, Christ, Pette and Brennan, JJ., concur.
