Appellant's brief is overdue. Appellant's brief was originally due November 8, 2023. On November 10, 2023, this Court granted appellant's motion for extension of time to file the brief and ordered the brief filed by December 8, 2023. On December 5, 2023, we granted appellant's second motion for extension of time to file the brief and ordered appellant's brief filed by January 17, 2024. As of the date of this order, appellant's brief has not been filed, and appellant's counsel, Mitchell Nolte, has not communicated with this Court concerning this case since December 12, 2023.

We ORDER Mr. Nolte to file appellant's brief and a motion for extension of time to file the brief on or before FEBRUARY 20, 2024. If appellant's brief and motion for extension are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See Tex. R. App. P. 38.8(b)(2).
