ORDER GRANTING UNOPPOSED MOTION TO DISMISS


THIS MATTER comes before the Court on Defendant United States of America's Motion to Dismiss (#43). The United States filed such motion to cure a jurisdictional defect and simultaneously moved to intervene. The Court has already allowed the United States to intervene. The Motion to Dismiss is unopposed.

IT IS THEREFORE ORDERED that the Motion to Dismiss (#43) is GRANTED. The caption shall be amended to delete reference to the United States as a Defendant.
