Respondent New York State Office of Children and Family Services having moved for leave to file a corrected brief on this CPLR article 78 proceeding transferred to this Court by order of Supreme Court entered in the Office of the Clerk of the County of Niagara on August 8, 2012,

Now, upon reading and filing the affirmation of Jonathan D. Hitsous, Esq., dated March 19, 2013, the notice of motion with proof of service thereof, and the affirmation of Kevin S. Mahoney, Esq., dated March 28, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that the corrected brief is filed and served on or before April 19, 2013, and the Clerk is directed to accept the corrected brief for filing.
