FE EXPRESS, LLC, Francisco Javier Bernal and Hector Lopez, Appellants v. Maria Isabel Serna CONTRERAS, as Next Friend and Guardian of Samara Isabella Morales Serna and Samantha Isabel Morales Serna, Minor Children, and as Administrator of the Estate of Samuel Morales Castillo, Deceased, Appellees
From the 341st Judicial District Court, Webb County, Texas
Trial Court No. 2014CVT001295 D3
Honorable Rebecca Ramirez Palomo, Judge Presiding
ORDER
Sitting: Sandee Bryan Marion, Chief Justice Luz Elena D. Chapa, Justice Irene Rios, Justice
FE Express LLC has filed an opposed amended emergency motion for stay of enforcement of the trial court's judgment pending our review of the trial court's supersedeas ruling. The motion is granted. We order that the enforcement of the judgment will be suspended pending our ruling on the motion to review the trial court's supersedeas ruling. See TEX. R. APP. P. 24.4(c). FE Express LLC has represented to this court that it has requested a supplemental reporter's record and a supplemental clerk's record. We order FE Express LLC to file a copy of those requests in this court by August 10, 2017. We further order the supplemental reporter's record and the supplemental clerk's record due by August 17, 2017.
The "motion must be heard at the earliest practicable time." See id. R. 24.2(d). Appellees' response, if any, is due seven days after the supplemental record is filed. No extensions of time will be granted absent a timely motion or request that (1) demonstrates extraordinary circumstances justifying further delay, (2) advises the court of the efforts expended in preparing the filing, and (3) provides the court reasonable assurance that the filing will be completed and filed by the requested extended deadline. The court does not generally consider a heavy work schedule to be an extraordinary circumstance.
