Brian FAZIO, Appellant v. The STATE of Texas, Appellee

From the 290th Judicial District Court, Bexar County, Texas
Trial Court No. 2016CR5284
Honorable Melisa Skinner, Judge Presiding

ORDER

On December 12, 2017, appellant's counsel filed what he entitled "Appellant's Anders Brief." Soon thereafter, appellant filed a motion explaining that he had improperly titled the brief as an Anders brief, and asked for leave to file an amended brief to correct the error. He also filed the amended brief correcting the error. After review, we GRANT appellant's motion to file an amended brief correcting the described error and ORDER the amended brief accepted as filed. However, we note that in appellant's amended brief, he failed to include a certificate of compliance pursuant to Rule 9.4(i)(3) of the Texas Rules of Appellate procedure. Accordingly, we ORDER appellant to file the mandated certificate of compliance within ten days of the date of this order. The State's brief is due on or before January 11, 2017.
