Brian FAZIO, Appellant v. The STATE of Texas, Appellee

From the 290th Judicial District Court, Bexar County, Texas
Trial Court No. 2016CR5284
Honorable Melisa Skinner, Judge Presiding

ORDER

Appellant's brief was originally due October 5, 2017. When neither the brief nor a motion for extension of time to file the brief was filed, this court sent a notice to appellant. See Tex. R. App. P. 38.8. On October 12, 2017, in response to our notice, appellant filed a motion for extension of time to file the brief. In that motion, appellant asks for an extension to December 4, 2017. After review, we GRANT IN PART AND DENY IN PART appellant's motion for extension of time. We GRANT appellant an extension of time to November 13, 2017 - thirty days from the date the extension was filed (the actual thirtieth day is Saturday, November 11, 2017). We DENY appellant's request that we extend time to file the brief to December 4, 2017. This does not preclude appellant from filing an additional request for extension of time. Accordingly, we ORDER appellant to file his brief in this court on or before November 13, 2017.
