STIPULATION FOR DISMISSAL OF PLAINTIFFS' ACTION
IT IS HEREBY STIPULATED by and between Plaintiffs and Defendants WORLD SPIRITS, [NC.; TRADER VIC'S; TRADER VIC'S FOOD PRODUCTS; PARADISE BEVERAGES, [NC.; HAWAIIAN RECTIFIERS, [NC., formerly doing business as Hawaiian Distillers, Inc., and currently doing business as Hawaiian Distilled Products Company (collectively, "Defendants") that the above-captioned action be, and hereby is, dismissed with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1). Plaintiffs and Defendant's further stipulate that each party shall bear its own costs and fees, and that neither plaintiffs nor defendants shall seek the recovery of its costs and fees in this case from the other party. IT IS HEREBY ORDERED that Plaintiffs DAVID E. FAZENDIN AND ALOHA DISTILLERS, INC. is dismissed with prejudice with all parties to bear their own costs.
