MEMORANDUM OPINION


The parties to this appeal have filed a joint motion asking the court to set aside the trial court's judgment without regard to the merits and remand the case to the trial court for disposition in accordance with the parties' agreement. The parties further ask that costs be assessed against the party that incurred them.

We grant the motion. The judgment of the trial court is set aside without regard to the merits and the cause is remanded to the trial court for disposition in accordance with the parties' agreement. See Tex.R.App.P. 42.1(a)(2)(B). Costs of appeal are taxed against the parties who have incurred them.
