ORDER
The brief of appellant Tom Fatjo Jr. was originally due November 6, 2017; however, the court granted extensions of time until January 5, 2018, to file the brief. Our last order advised appellant that no further extensions of time would be granted absent a showing of extraordinary circumstances justifying further delay and reasonable assurance that the brief or a motion disposing of this appeal would be filed by the requested extended deadline.
Appellant has filed a motion to further extend time for filing appellant's brief. The motion states the parties "have an agreement in principle to settle this case," requests an extension of time until February 5, 2018 (ninety days after the original deadline), and represents that "[n]o further extensions will be requested."
We grant the motion. We order appellant's brief or a motion to dispose of this appeal is due February 5, 2018. No further extensions of time will be granted. Appellant is given notice that if the brief or a motion to fully dispose of the appeal is not filed by the date ordered, the appeal may be dismissed. See Tex. R. App. P. 42.3(c).
