ORDER OF DISMISSAL


The above captioned case was filed January 13, 2003. A review of the record reveals that the Defendant has not been served with the complaint in this case pursuant to Rule 4 of the Federal Rules of Civil Procedure.

On October 20, 2003, this court issued an Order to Show Cause why this case should not be dismissed for failure to prosecute. [Docket entry 6-1]. The order advised Plaintiff that failure to respond would result in dismissal. Plaintiff did not file a response to the Order to Show Cause.

ACCORDINGLY, IT IS HEREBY ORDERED that this case is DISMISSED for failure to prosecute.
