MICHAEL MELVIN FARY v. COMMONWEALTH OF VIRGINIA
Devin G. Hensley (Martin, Ingles & Hensley Ltd.) for appellant. Timothy J. Huffstutter (Office of the Attorney General) for appellee.
The Court of Appeals of Virginia.
Devin G. Hensley (Martin, Ingles & Hensley Ltd.) for appellant.
Timothy J. Huffstutter (Office of the Attorney General) for appellee.
GRANTED APPEAL SUMMARY
Assignment of Error
I. The Court of Appeals erred when it affirmed the circuit court's judgment because the evidence was not sufficient to convict appellant of seven counts of attempted malicious wounding when appellant did not have the specific intent required to maliciously wound anyone when his boat came into contact with the victims' boat.
