MEMORANDUM OPINION


In this proceeding, Plaintiff sought damages for claims under the Age Discrimination and Employment Act of 1967 ("ADEA") and other claims which have heretofore been dismissed by order of this court. For reasons hereafter found, the remaining claim under ADEA should be dismissed.

A recitation of the facts would not be necessary, for Plaintiff concedes that the facts recited by Defendant in the brief on the summary judgment motion are true.

Plaintiff further concedes that precedent prohibits Plaintiff from successfully defending against the motion for summary judgment. The reasoning set forth in Bacchus v. Tubular Textile. LLC. 1:01CV00621, is fully applicable to this proceeding.

A judgment in accordance with this memorandum opinion shall be filed contemporaneously herewith.
