DECISION AND ORDER ON MOTION

Motion for stay pending determination of proceeding.

Motion to dismiss petition and to vacate stay.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion for a stay pending the determination of the proceeding is granted, without costs, and it is further

ORDERED that the motion to dismiss the petition is denied, without costs, and without prejudice to the issues involved being raised upon the argument of the proceeding, and it is further

ORDERED that the motion to vacate the stay is denied, without costs.
