On Appeal from the 245th District Court Harris County, Texas Trial Court Case No. 2002-46326
Panel consists of Justices Goodman, Rivas-Molloy, and Farris.
MEMORANDUM OPINION
PER CURIAM
Appellant Darryl Dwayne Farley failed to file an appellate brief. See Tex. R. App. P. 38.8(a). On October 8, 2021, we notified Appellant of the failure and further advised him that his appeal could be dismissed for want of prosecution. We advised Appellant that he had to file a motion requesting an extension of time along with his brief or a motion to extend time to file a brief within ten days of our order. Appellant did not respond. To date, Appellant has not filed a brief or responded to our notice. See Tex. R. App. P. 42.3(b), (c).
We dismiss the appeal for want of prosecution for failure to file a brief. See Tex. R. App. P. 38.8(a)(1), 42.3(b), (c), 43.2(f). We dismiss any pending motions as moot.
