ORDER MODIFYING OPINION

[NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on December 3, 2007, be modified in the following particulars:

On page 5, the last sentence at the end of the fourth full paragraph, beginning “Alternatively, Dominic asserts” the name “Dominic” is deleted and “Steven” is inserted in its place so the sentence reads:

Alternatively, Steven asserts that, in the absence of a properly executed exhibit A to the third amendment, “the trust assets should retain their original character at the time the assets were first transferred to the Trust.”

This modification does not effect a change in the judgment.
