Defendants James L. Cuyler and Georgia Cuyler having moved to consolidate the appeals taken herein from a judgment and orders of the Supreme Court entered in the Office of the Clerk of the County of Monroe on May 9, 2013 (appeal No. 1), June 4, 2013 (appeal No. 2), and June 7, 2013 (appeal No. 3), and having moved for an order designating plaintiffs as the parties bearing primary responsibility for filing the consolidated record on these appeals,

Now, upon reading and filing the affidavit of Steven P. Curvin, Esq., sworn to July 29, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is granted, and the appeals from the judgment and orders entered May 9, 2013, June 4, 2013, and June 7, 2013, are hereby consolidated for the purposes of perfecting and arguing the appeals, and

It is further ORDERED that the motion is otherwise denied.
