Cearth FAIRE, Appellants v. ALL JONES, LLC, Appellee

MEMORANDUM OPINION

From the County Court at Law No. 3, Bexar County, Texas
Trial Court No. 2015CV05205
Honorable David J. Rodriguez, Judge Presiding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Luz Elena D. Chapa, Justice Jason Pulliam, Justice DISMISSED

Cearth Faire appeals the trial court's judgment signed October 2, 2015. Faire's brief was originally due March 22, 2016. Neither the brief nor a motion for extension of time was filed. On March 29, 2016, we ordered Faire to file, not later than April 8, 2016, the appellant's brief and a written response reasonably explaining the failure to timely file the brief. We advised Faire that if the written response was not filed by the date ordered, we would dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(a); see also TEX. R. APP. P. 42.3(c) (providing the court may dismiss appeal because appellant has failed to comply with a court order within the time provided). Faire has not filed a brief or the written response ordered by the court.

We therefore order this appeal dismissed. We further order that appellee, All Jones, LLC, recover its costs in this appeal from Faire.

PER CURIAM
