F. Camilon & A. Molarte Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Emin Toro, Judge

On April 2, 2020, the trial session scheduled to begin in Los Angeles, California, on May 18, 2020, was canceled due to concerns related to COVID-19, and this case was assigned to the undersigned judge. On January 19, 2022, the parties filed a Joint Status Report (Doc. 68) informing the Court that petitioner's counsel anticipates filing a motion to compel the subpoena for testimony from a third-party witness unless the third-party witness changes its position with regard to responding to the subpoena. The undersigned judge is scheduled to preside over the Court's March 21, 2022, Los Angeles, California, in-person Special Trial Session, and believes it to be in the interest of judicial economy to preside over a Status Hearing in this case should one be necessary. To that end, this case will also be added to the calendar for that session. Upon due consideration, it is hereby

ORDERED that this case is calendared for hearing on the status of the case during the Court's Special Trial Session scheduled to take place in Room 1167, 11th Floor, Edward R. Roybal Center & Federal Building, 255 E. Temple Street, Los Angeles, California 90012, beginning at 10:00 a.m. Pacific Time on Monday, March 21, 2022, at which time any motions to compel the subpoena for testimony from third-party witnesses will be heard. It is further

ORDERED that, on or before March 7, 2022, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document. The report shall include whether the third-party witness has complied with the subpoena.

This Order constitutes official notice to the parties.
