DECISION AND ORDER ON MOTION

Motion to vacate statutory stay and/or to expedite appeal.

Upon the papers filed in support of the motion and the papers filed in response and in opposition thereto, it is

ORDERED that the motion to vacate the statutory stay is granted, without costs, and it is further

ORDERED that the motion to expedite the appeal is granted, without costs, to the extent that the appeal is set down for the May 2017 term of this Court. The record on appeal and brief shall be filed and served on or before April 21, 2017 and the briefs of petitioners and respondents New York State Education Department and Commissioner of Education shall be filed and served on or before May 5, 2017. The reply brief, if any, shall be filed and served on or before May 22, 2017.
