In this accelerated appeal, the Court abated and remanded the case to the trial court for the trial court to execute a certification of appellant's right to appeal that complied with Texas Rule of Appellate Procedure 25.2(d). Subsequently, the trial court clerk filed a supplemental clerk's record containing a certification of appellant's right to appeal indicating that appellant "has the right of appeal." On October 3, 2023, the Court reinstated the appeal on the Court's active docket and informed appellant, Kimberly Williams, that her brief was due thirty days from the date of the order. On October 16, 2023, appellant filed a Motion for Extension of Time to File Brief, requesting that the Court extend her deadline to file an appellant's brief to January 2, 2024. The court granted appellant's motion, extending appellant's deadline to January 2, 2024, "with no further extensions." On December 27, 2023, appellant filed a second Motion for an Extension of Time to File Brief, requesting an "additional 60 days" to file her brief.
Appellant's second motion for an extension of sixty days, is denied.
Appellant's brief is due on or before Friday, February 2, 2024. See Tex. R. App. P. 31.1(a). If appellant fails to timely file her brief, this Court will either abate the appeal and order the trial court to conduct a hearing as to appellant's failure to file a brief or the Court will withdraw its briefing request. See Tex. R. App. P. 31.1(b). The State's brief, if any, will be due thirty days after the date appellant's brief is filed.
