Before the Court is the request for an extension of time to file the clerk's record filed on May 12, 2022 by the Collin County Clerk. The clerk requests an extension because appellant has not paid the fee for preparation of the clerk's record. Appellant has not filed a docketing statement. There is nothing before this Court that would indicate appellant is an indigent.
We GRANT the clerk's request and extend the time to file the clerk's record until May 23, 2022. See Tex. R. App. P. 35.3(c).
If the clerk's record is not timely filed, we ORDER appellant to file, on or before June 6, 2022, either proof that he has paid for preparation of the clerk's record, proof that he has made arrangements to pay for the clerk's record, or proof that he is an indigent entitled to proceed without payment for the clerk's record. See Tex. R. App. P. 35.3(a)(2).
Upon the filing of the clerk's record, the Court will reset briefing deadlines.
We DIRECT the Clerk to send copies of this order to the Honorable Corrine A. Mason, Presiding Judge, County Court at Law No. 1; Stacey Kemp, Collin County Clerk; and counsel for all parties.
