No. 04-16-00657-CV

From the 288th Judicial District Court, Bexar County, Texas
Trial Court No. 2016-CI-07718
Honorable Peter A. Sakai, Judge Presiding
ORDER
On September 19, 2016, appellant, the Texas Attorney General's Medicaid Fraud Unit, filed its notice of appeal. On November 10, 2016, the court reporter responsible for preparing the reporter's record in this appeal filed a notification of late record, stating that she had not received a request for the reporter's record and that the appellant had failed to pay or make arrangements to pay the fee for preparing the reporter's record. On November 17, 2016, we ordered appellant to provide written proof to this court within ten days that either the reporter's fee had been paid or that the appellant was entitled to appeal without paying the reporter's fee. We further ordered that if appellant did not respond within the time provided that appellant's brief would be due on December 19, 2016, and the court would only consider those issues or points raised in appellant's brief that did not require a reporter's record for a decision.
To date, neither appellant's brief nor a motion for extension of time have been filed. Therefore, it is ORDERED that appellant show cause in writing within fifteen days from the date of this order why this appeal should not be dismissed for want of prosecution. See TEX. R. APP. P. 38.8(a)(1).
