On Appeal from the County Court of Kinney County, Texas
Before Chief Justice Contreras and Justices Benavides and Silva
ORDER OF REINSTATEMENT
PER CURIAM.
Appellant Cristian Medina-Garcia challenges the trial court's denial of his pre-trial application for writ of habeas corpus. On December 27, 2023, we granted appellant's unopposed motion to abate the appeal pending the Texas Court of Criminal Appeals' disposition of Ex parte Aparicio, a case which involves substantially similar facts and issues.
The Texas Court of Criminal Appeals has issued its opinion in Ex parte Aparicio. No. PD-0461-23, 2024 WL 4446598 (Tex. Crim. App. Oct. 9, 2024). Accordingly, this appeal is hereby reinstated. The trial court clerk is directed to file the amended clerk's record within fifteen days of the date of this order. See Tex. R. App. P. 31.1. Appellant's brief shall be due within thirty days after the filing of the clerk's record. The State's brief shall be due within thirty days after the filing of appellant's brief. Appellant's reply brief, if any, shall be due within twenty days after the filing of the State's brief.
