On April 16, 2018, appellant, through counsel, filed a notice of appeal from the trial court's order, signed on March 26, 2018, denying his pretrial habeas application. On May 4, 2018, the clerk's record was filed in this Court and the court reporter filed an info sheet stating that no reporter's record of the writ hearing was taken. Appellant is challenging Section 21.16(b) of the Texas Penal Code as facially unconstitutional. The Clerk of this Court's May 8, 2018 notice has requested that a supplemental clerk's record be filed with an amended certification of appellant's right of appeal. See TEX. R. APP. P. 37.1. After a review of the records, the Court determines that it desires briefing. See id. 31.1.
Accordingly, appellant's brief is ORDERED to be filed no later than 20 days from the date of this order. See TEX. R. APP. P. 2, 31.1. The State's brief, if any, is ORDERED to be filed no later than 20 days from the filing of the appellant's brief.
