The State's brief was due by July 8, 2024, but it was not filed. Instead, on July 8, 2024, appellant filed a motion requesting a forty-five day extension of time to file a reply brief. Thereafter, on July 18, 2024, the State informed this court by telephone it intended to file a motion for extension of time to file its brief. However, as of date, the State has not filed either a motion for extension of time or its brief.
Accordingly, we order the State to file its brief by August 13, 2024. The State is advised if the brief is not filed, the case may be set at issue without a State's brief. We further grant appellant's motion and order appellant to file his reply brief forty-five days from the date the State files its brief should the State file one.
