ORDER
BILL PEDERSEN, III JUSTICE
Before the Court are appellant's April 20, 2022 pro se motion to release Mitchell Nolte as his attorney and pro se notice of appearance, April 20, 2022 pro se motion for bond pending appeal, April 25, 2022 pro se motion for reconsideration of denied motions, April 25, 2022 pro se brief, and counsel's letter to the Court filed April 26, 2022.
In his letter, counsel reports appellant has indicated his desire to waive his objection to his extradition and withdraw his appeal. Counsel has requested an evidentiary hearing before the trial court for April 28, 2022.
In light of counsel's letter, we defer ruling on the various matters before the Court and ABATE this appeal to allow the trial court to conduct an evidentiary hearing to determine the status of this appeal.
The appeal shall be reinstated upon the earliest occurrence of any of the following: (1) when counsel files a motion to dismiss the appeal conforming to rule of appellate procedure 42.2(a); (2) when a supplemental clerk's record or reporter's record is filed documenting the outcome of the April 28, 2022 status hearing; or (3) thirty days from the date of this order.
We DIRECT the Clerk of the Court to transmit copies of this order, by electronic transmission, to the Honorable Benjamin N. Smith, Presiding Judge, 380th Judicial District Court, and to counsel for the parties.
We further DIRECT the Clerk of the Court to mail a copy of this order, by first class mail, to Norman Joseph Landry, SO# 387026, c/o Collin County Sheriff's Department, 4300 Community Avenue, McKinney, Texas 75071.
