EX PARTE NORMAN JOSEPH LANDRY

On Appeal from the 380th Judicial District Court Collin County, Texas Trial Court Cause No. 380-00932-2022

ORDER

BILL PEDERSEN, III JUSTICE

The Court is in receipt of appellant's pro se notice of appeal from a ruling of the trial court. The notice of appeal indicates appellant is appealing an extradition order on a governor's warrant from the State of Rhode Island. However, an appeal information sheet prepared by the Collin County District Clerk shows the appeal arises from the denial of an application for writ of habeas corpus seeking a bond reduction. The Collin County District Clerk's online docket sheet also reflects the underlying cause involves an application for writ of habeas corpus appellant filed regarding a bond reduction. Under either circumstance, this is an accelerated appeal and is governed by Texas Rule of Appellate Procedure 31.

We ORDER the trial court to prepare a certification of appellant's right to appeal and to file it with the clerk's record.

We ORDER the Collin County District Clerk to file the clerk's record by March 24, 2022. We ORDER that the clerk's record contain copies of the indictment, if any has been filed; the application for writ of habeas corpus; any response to the writ application filed by the State; any other documents related to the writ application; the trial court's order ruling on the writ application; any findings of fact on the writ application that the trial court has entered; the trial court's certification of the right to appeal; any other documents filed with the clerk that the parties request; and, if this case involves an extradition as appellant states, copies of the governor's warrant and supporting papers related to appellant's extradition.

We ORDER the reporter's record of the hearing on the writ application or extradition, if any, be filed by March 24, 2022.

We ORDER appellant to file his brief by April 15, 2022. We ORDER the State to file its brief by May 6, 2022. If appellant desires to file a reply brief, the reply brief is due within fifteen days of the date the State files its brief. After the record and briefs have been filed, the Court will notify the parties of the submission date and panel.

We DIRECT the Clerk to send copies of this order to the Honorable Benjamin N. Smith, Presiding Judge, 380th Judicial District Court; Karla Kimbrell, official court reporter, 380th Judicial District Court; Lynne Finley, Collin County District Clerk; and counsel for all parties.
