On October 4, 2017, relator filed a petition for writ of habeas corpus and a motion for emergency relief. This court is of the tentative opinion that relator is entitled to the relief sought. See TEX. FAM. CODE ANN. § 201.005 (West Supp. 2016); TEX. R. APP. P. 52.8(b). The respondent and the real parties in interest may file a response to the petition in this court no later than October 19, 2017. Any such response must conform to Texas Rule of Appellate Procedure 52.4.
Relator's motion for emergency relief is GRANTED. The Bexar County Sheriff is ORDERED to release relator, Rollie Bryan Keith (d.o.b. 03-31-1962), from custody. The order for issuance of capias and all further court proceedings in trial court cause No. 2014CI09063 are STAYED pending final resolution of the petition filed in this court.
It is so ORDERED on October 5, 2017.
