EX PARTE J.M.L.

On Appeal from the 86th Judicial District Court Kaufman County, Texas Trial Court Cause No. 114436-86.

ORDER

CORY L. CARLYLE, JUSTICE.

This appeal follows an order of expunction. By letter filed June 4, 2024, Elizabeth Woods, Official Court Reporter for the 86th Judicial District Court, informs the Court appellant has requested the reporter's record of the underlying proceedings and questions whether the record can be filed in light of section 1 of article 55.04 of the Texas Code of Criminal Procedure. See TEX. CODE CRIM. PROC. ANN. art. 55.04, § 1 (providing, in part, that officer or employee of state, state agency, or political subdivision of state commits offense if, knowing of expunction order, “knowingly releases, disseminates, or otherwise uses the records or files” that are subject of expunction order).

We construe the letter as a request for an extension of time to file the record, GRANT the request, and ORDER the record be filed under seal no later than July 22, 2024. See id. art. 55.02, § 5(c) (providing, in part, that court records concerning expunction proceedings are not open for inspection by anyone except person who is subject of order).
