EX PARTE NEHEMIAH J.D. JACKSON
On Appeal from the Criminal District Court No. 7 Dallas County, Texas
Trial Court Cause No. X-14-1194-Y
ORDER
Before the Court is appellant's December 31, 2018 motion for an extension of time. The motion was filed in response to the Court's December 19, 2018 letter in which we notified appellant that the brief he had filed was deficient and directed him to file an amended brief within thirty days of the reporter's record being filed. Since our letter was sent, Vearneas Faggett, Official Court Reporter for Criminal District Court No. 7, has informed the Court that no hearings were recorded.
We note that appellant is incarcerated and filed his brief without the benefit of a copy of the clerk's record. Among the noted deficiencies in this Court's December 19 letter is the failure to include references to the record. See TEX. R. APP. P. 38.1(d), (g), and (i). In light of these circumstances, we GRANT appellant's motion as follows: we DIRECT the Clerk of this Court to send appellant a paper copy of the clerk's record and we ORDER appellant to file, by February 25, 2019, his amended brief correcting the deficiencies noted in this Court's December 19 letter.
