Opinion

No. 05-05-00938-CR

Opinion Filed September 14, 2005. DO NOT PUBLISH. Tex.R.App.P. 47.

On Appeal from the County Criminal Court No. 10, Dallas County, Texas, Trial Court Cause No. MC2005-A4611. Dismiss.

Before Justices MOSELEY, BRIDGES, and O'NEILL.

MEMORANDUM OPINION

Cicero Fred Jackson appealed the trial court's order denying his application for writ of habeas corpus in which appellant sought to withdraw the guilty plea he entered in trial court no. MA99-21110-L, styled Cicero Fred Jackson v. The State of Texas. The documents before the Court reflect that the trial judge denied appellant's application without considering the merits, leaving us without jurisdiction over the appeal. See Ex parte Noe, 646 S.W.2d 230, 231 (Tex.Crim.App. 1983). Accordingly, we dismiss the appeal for want of jurisdiction.
