Ex parte Isaac Humphrey

Trial court: 183rd District Court of Harris County, Trial court case number: 1785410 & 1785411

ORDER

Peter Kelly Judge

Appellant Isaac Humphrey is represented by appointed counsel, Christopher Self. Humphrey is charged with the offenses of compelling prostitution and trafficking of persons. Appointed counsel filed an application for writ of habeas corpus in both trial court causes, contending that the statutes with which Humphrey was charged are unconstitutional. The trial court denied the applications and appointed counsel filed notices of appeal. The Court requested briefing. One extension was granted until August 1, 2023. No brief or motion for extension was filed despite notice issued on August 17, 2023.

It has come to the Court's attention that appointed counsel Brandon Ball was substituted in place of Christopher Self on motion filed in the trial court and granted on July 20, 2023 without notice to this Court or motion to substitute filed in this Court.

The Court orders appointed counsel Ball to file within 10 days a motion to substitute in this appeal. The motion to substitute should comply with the requirements of Rule 6.5(d). See Tex. R. App. P. 6.5(d). Counsel is also ordered to file brief within 30 days. No further extensions will be granted. Should Ball fail to comply with this order, the Court will remand for a hearing in the trial court.

It is so ORDERED.
