EX PARTE RICKEY HICKS

On Appeal from the Criminal District Court No. 5 Dallas County, Texas Trial Court Cause No. WX21-93115-T

ORDER

LANA MYERS, JUSTICE.

On May 16, 2022, appellant's counsel filed a combined voluntary motion to dismiss the appeal and motion to withdraw as counsel on appeal. A motion to dismiss an appeal must be signed by both counsel and appellant. See Tex. R. App. P. 42.2(a). Appellant's motion is signed only by counsel. A motion to withdraw as counsel must comply with rule of appellate procedure 6.5. The motion counsel filed does not comply with the procedures for withdrawal set forth in the rule. See Tex. R. App. P. 6.5(a), (b). Accordingly, we DENY the combined motion.

We ORDER appellant's counsel to file, within FOURTEEN DAYS of the date of this order, an amended motion to dismiss the appeal signed by both counsel and appellant. If counsel also wishes to withdraw as counsel, he may file an accompanying amended motion to withdraw that complies with rule 6.5.
