ON APPLICATION FOR A WRIT OF HABEAS CORPUS CAUSE NO. W380-80420-99-HC3 IN THE 380TH DISTRICT COURT FROM COLLIN COUNTY

Per curiam. ORDER

Pursuant to the provisions of Article 11.07 of the Texas Code of Criminal Procedure, the clerk of the trial court transmitted to this Court this application for a writ of habeas corpus. Ex parte Young, 418 S.W.2d 824, 826 (Tex. Crim. App. 1967). Applicant was convicted of aggravated sexual assault and sentenced to life imprisonment. The Fifth Court of Appeals affirmed his conviction. Hamilton v. State, No. 05-06-01273-CR (Tex. App.—Dallas Jan. 28, 2008) (not designated for publication).

In his first and third grounds, Applicant contends that he was denied DNA testing and the appointment of appellate counsel. In his second ground, he contends that the court of appeals refused to file his motion for leave to file an out of time pro se response. Applicant's first and third grounds are dismissed. See TEX. CODE CRIM. PROC. art. 11.07, § 4. His second ground is denied. Accordingly, this application is dismissed in part and denied in part. Filed: September 13, 2017
