EX PARTE GUSTAVO GARZA

From the 227th Judicial District Court, Bexar County, Texas
Trial Court No. 2019CR3143
Honorable Andrew Wyatt Carruthers, Judge Presiding

ORDER

On September 23, 2020, we ordered appellant to file a response showing cause why this appeal should not be dismissed for want of jurisdiction since the clerk's record did not contain a signed, written order denying his application for writ of habeas corpus. On November 4, 2020, appellant filed a response stating he has been unable to obtain a signed, written order and "the onus" may now be on the trial court. If counsel intends for his letter to serve as a petition of writ of mandamus regarding the trial court's failure to rule, it must be refiled as such. Otherwise, without a supplemental clerk's record containing a signed, written order to establish this court's jurisdiction, this case will be dismissed in thirty days.

Beth Watkins, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 12th day of November, 2020.

/s/_________

Michael A. Cruz,

Clerk of Court
