ON APPLICATION FOR A WRIT OF HABEAS CORPUS CAUSE NO. 2002DD05515-384-1 IN THE 384TH DISTRICT COURT FROM EL PASO COUNTY

Per curiam. ORDER

Applicant was convicted of obstruction / retaliation and sentenced to two years' imprisonment. He did not file a direct appeal. Applicant filed this application for a writ of habeas corpus in the county of conviction, and the district clerk forwarded it to this Court. See TEX. CODE CRIM. PROC. art. 11.07.

The Court received this writ application on December 10, 2019. On January 8, 2020, this Court dismissed it as subsequent. TEX. CODE CRIM. PRO. Art. 11.07, sec. 4. However, it has now come to the Court's attention that Applicant's prior habeas application was pertaining to a different cause number. Due to that error, this application would no longer be considered subsequent and should be addressed on the merits. Accordingly, the Court withdraws its prior ruling which dismissed this application without written order, reopens the application, and enters this order denying the application based on the merits.
